The Hamilton Police Service has arrested a suspect following the theft of an urn from a mausoleum at Resurrection Cemetery, located at 254 Garner Road West in Ancaster.

On November 2, 2025, the victim attended the cemetery to visit his infant daughter, who had passed away in recent months. Upon entering the mausoleum, he discovered that his daughter’s urn, which contained her ashes, had been stolen.

Hamilton Police reviewed CCTV footage from the cemetery and immediately began an extensive investigation. Through investigative work, detectives identified the suspect captured on camera committing the theft as Kevin Wintonyk, a 37-year-old man of no fixed address. Wintonyk is known to police and has a history of similar cemetery-theft offences.

On November 5, 2025, investigators located Wintonyk in Niagara Falls, where he was arrested without incident. The stolen urn was recovered, along with several other items believed to have been taken from additional gravesites.

Kevin Wintonyk has been charged with the following offences:

  • Indignity to Human Remains
  • Break and Enter to Commit
  • Possession of Property Obtained by Crime Under $5,000
  • Fail to Comply with Probation ×2
  • Possession of Property Obtained by Crime

He is currently in custody pending a bail hearing.

Hamilton Police were relieved to reunite the victim’s family with their loved one’s remains.
